Terms of Service

The Participant name below (hereafter the “Participant”) requests to be involved in activities in a space made available by Next Level Baseball LLC (hereafter NLB). The Participant and/or legal guardian acknowledge that:

  • There are risks of personal injury associated with participation in athletic programs, events and activities which can result in temporary or permanent disabilities, injury, death and/or property loss.

  • NLB has not and will not make any medical evaluation in regards to the fitness, physical condition or overall health of the Participant.

  • By being in the building there is inherent risk of injury, disability, or death by the fact that you are around activity even though Participant may not be currently engaged in any activity at the time of or leading up to the potential for injury.

In consideration of NLB permitting the Participant into the building, events, and/or activities and with the knowledge of the risks associated with this involvement that may come to the Participant, I/We agree to the following:

  • I/We consent to the Participant being involved in programs, events, and activities at NLB.

  • I/We will acknowledge and follow the rules of conduct and facility management expectations and the Participant will conduct themselves in a safe manner to themself and those around them at any time they have entered the NLB facility.

  • I/We accept full responsibility for consulting a doctor or medical professional about any training, or physical activity done at any NLB facility. The Participant has no physical or mental disability or limitation that would deter them from participating at any activity at any NLB facility. I//We grant permission for medical treatment to be given at a local hospital or medical facility or in the facility by emergency or medical professionals and will be responsible for any costs associated with medical treatment or emergency response.  I/We acknowledge that NLB is not responsible or required to provide first aid or seek medical treatment for Participant.

  • I/We assume all risk and responsibility for accidents, illness, injury, death, disability whether temporary or permanent, damages which may result from the Participant traveling to or from participating in any activity conducted by NLB or at the NLB facility. I/We hereby waive, release and discharge NLB and all tenants, together with their staff, members, officers, directors, employees and agents, any Graves family member or anyone or any entity associated with NLB (hereafter “Released Parties”) from any and all liability.  I/We are giving up rights to bring legal action or assert a claim against Released Parties for their negligence or any defective product or condition encountered at NLB.

  • I/We agree to indemnify, hold harmless and defend Released Parties from any and all claims, lawsuits, demands, damages, liabilities, losses, expenses, including attorney’s fees and administrative expenses, of every kind, known and unknown, present and future, in any way related to Participant’s participations in training activities, athletic activities, and events conducted by NLB or in the space NLB provides.  I/We further expressly agree that this waiver, release, and indemnity agreement is meant to be as broad and inclusive as possible as permitted by law in the state of Minnesota and that if any portion hereof is held invalid, it is agreed that the balance shall notwithstanding, continue in full legal force and effect.

  • The World Health Organization and the Centers for Disease Control have declared Covid-19 a pandemic.  By training at NLB, I/We assume the risk of being exposed to and infected with the Covid-19 virus and I/We will not hold NLB or any of its representatives liable for any potential or actual exposures.

  • I/We agree that this agreement extends forever into the future and applies to all current and future programs, events, and activities by Participant with NLB.

  • NLB may take pictures and video or voice recordings of the Participant or spectators and I/We grant permission for NLB to use that media of the minor/ward’s name, likeness, image or quote for use as deemed useful by NLB.

  • I/We agree to follow the NLB Facility Rules:

  • This is a family-friendly facility - no foul, racist, or otherwise offensive language or apparel.

  • No alcohol or tobacco products (including vaping) allowed inside or outside of the facility,

  • No outside shoes or cleats on the turf. Change into clean shoes upon arrival.

  • No beverages other than water on the turf.

  • No food, sunflower seeds, or gum anywhere in the facility.

  • No spitting.

  • After entering a batting cage, secure the netting behind you to enclose the cage.

  • Do not hang on the netting.

  • Only 2 people in a batting cage at a time, including only one batter.

  • Using the pitching machine requires an adult present.

  • Batters must always wear helmets in the cages.

  • Pitchers throwing to hitters must use the L-screens provided.

  • No swinging bats outside the batting cages.

  • Be prompt. Leave the cage on time so the next person can get started.

  • Appropriate adult supervision is required.

  • Pickup after yourself, put all balls back into buckets. Failure to do so will result in a $10 cleanup fee.

  • Stealing baseballs will result in getting banned from the Next Level Baseball facility.

Cancellation Policy

Batting cage rentals: Reservations must be cancelled or rescheduled online at least 2 hours before the batting cage rental is set to begin. Failing to do so will result in being charged for the reservation.

Group classes: Registrations must be cancelled online at least 7 days prior to when the class is set to begin. Classes cannot be cancelled within 7 days without a valid medical reason, however, credit will be given for a future class. Players that must withdraw from a camp or clinic due to a valid medical or emergency reason, will be refunded a pro-rated amount.

Only one makeup class will be offered at the end of each session. No other refunds will be offered for additional missed sessions.

1 on 1 Instruction: Sessions must be cancelled or rescheduled online at least 24 hours before the session is set to begin. Failing to do so will result in being be charged for the session.

Facility Rentals: Reservations must be cancelled or rescheduled online at least 24 hours before the facility rental is set to begin. Failing to do so will result in being be charged for the reservation.

Privacy Policy

We take your privacy seriously and do not share information with any other organization, except as necessary to complete a transaction. Next Level Baseball will not sell or rent your personally identifiable information to anyone.
